Hon. Brian A. Davis (Ret.) is an experienced civil litigator who was appointed in 2013 to the Massachusetts Superior Court, where he served as an Associate Justice for over eleven years. During his tenure on the bench, Judge Davis heard and decided thousands of motions of practically every type in a wide range of civil and criminal cases, presided over more than a hundred jury and non-jury trials, and conducted numerous mediations and other forms of case settlement conferences. His judicial caseload included matters in all areas of civil law, including contracts, medical malpractice and other personal injury, wrongful death, legal malpractice, employment, real estate, insurance coverage, Chapter 93A, commercial and residential construction, and government regulation.
For four of his eleven years as an Associate Justice, Judge Davis sat in the Superior Court’s specialized Business Litigation Session (BLS), where he was responsible for resolving complex commercial disputes involving trade secrets, intellectual property, non-competition agreements, partnerships, joint ventures, fiduciary obligations, intra-family disputes, commercial leases, executive compensation agreements, corporate governance and dissolution of business entities, shareholder rights, and consumer class actions. Judge Davis earned a reputation as a smart, fair, well-prepared, and hard-working judge who treated litigants and their counsel with dignity and respect. He listens carefully and is receptive to differing viewpoints, but he remains focused and decisive. He is skilled in analyzing complex legal and factual issues and assessing the strengths and weaknesses of the parties’ positions, making him particularly well-qualified to help resolve even the most challenging disputes and cases.
Prior to his judicial appointment, Judge Davis spent twenty-seven years as an associate and partner in the Litigation Department of the Boston law firm of Choate, Hall & Stewart, LLP, where he specialized in complex commercial disputes, significant tort and personal injury actions, fraud and extra-contractual insurance litigation, and e-discovery matters. He has tried many cases in both state and federal courts, and served as the chair or co-chair of the firm’s Litigation Department for over eight years, as well as the chair of the firm’s Major Commercial Litigation Practice Group for more than five years.
